Who we are & scope
This Privacy Policy explains how the Axxonet group companies registered in India — Axxonet System Technologies Private Limited and Axxonet Solutions India (together, “Axxonet”, “we”, “us”, “our”) — collect, use, store, disclose and protect your personal data when you use axxonet.com, our mobile applications and our products and services (the “Services”).
For the purposes of the Digital Personal Data Protection Act, 2023 (the “DPDP Act”) and the rules made under it, Axxonet acts as the Data Fiduciary that determines the purpose and means of processing your personal data. You are the Data Principal to whom the personal data relates.
Personal data we collect
We collect personal data that you provide to us and data generated through your use of the Services. You may browse much of the site without identifying yourself; where a feature requires it, we ask only for what is necessary.
Purposes & lawful basis
Under the DPDP Act we process your personal data for lawful purposes on the basis of your consent or for certain legitimate uses permitted by the Act (for example, a purpose for which you have voluntarily provided your data, employment-related purposes, and compliance with law).
Where we rely on consent, it is sought through a clear request in plain language, describing the personal data collected, the purpose of processing, how you may exercise your rights, and how to complain to the Data Protection Board of India. We use your data to provide and improve the Services, respond to enquiries, process transactions, personalise your experience in aggregate, and send communications you have agreed to receive.
Your consent & withdrawal
Consent under the DPDP Act must be free, specific, informed, unconditional and unambiguous, given by a clear affirmative action, and limited to the personal data necessary for the specified purpose.
You may give, manage, review or withdraw your consent at any time, including through a registered Consent Manager. Withdrawing consent takes the same steps as giving it; withdrawal does not affect processing carried out before withdrawal, and some Services may become unavailable as a result.
Your rights as a Data Principal
Subject to the DPDP Act, you have the following rights, which you may exercise by contacting our Grievance Officer:
Duties of the Data Principal
The DPDP Act also places duties on you: to comply with applicable law when exercising your rights, not to impersonate another person, not to suppress material information or provide false particulars, and not to register false or frivolous grievances or complaints. Furnishing verifiably authentic information remains your responsibility.
Children's data
Where we knowingly process the personal data of a child (an individual under 18 years of age) or of a person with a lawful guardian, we obtain verifiable consent from the parent or guardian as required by the DPDP Act. We do not undertake tracking, behavioural monitoring or targeted advertising directed at children.
Cross-border transfer
We may transfer personal data to, or process it in, countries outside India, including through service providers. Such transfers are made in accordance with the DPDP Act, which permits transfer other than to countries or territories specifically restricted by the Central Government by notification.
Security & breach
We implement reasonable security safeguards to protect personal data against unauthorised access, alteration, disclosure or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
In the event of a personal data breach, we will notify the Data Protection Board of India and affected Data Principals in the manner and within the timelines prescribed under the DPDP Act and rules.
Data retention
We retain personal data only for as long as necessary to fulfil the purposes described in this policy or as required by applicable law. Where consent is withdrawn or the purpose is served, we will erase the personal data unless retention is required or permitted by law.
Grievance Officer & Data Protection Board
If you have a concern about how your personal data is handled, please contact our Grievance Officer through the details on our contact page. We will respond within the period prescribed by the DPDP Rules.
If your grievance is not resolved to your satisfaction, you may lodge a complaint with the Data Protection Board of India in accordance with the DPDP Act.
Disclaimers & limitation
You are responsible for the accuracy and completeness of the personal data you provide, and Axxonet is not liable for any loss arising from inaccurate, incomplete or outdated information supplied by you. The Services may contain links to third-party websites whose privacy practices we do not control and for which we accept no responsibility.
To the fullest extent permitted by applicable law, and provided we have implemented reasonable security safeguards, Axxonet, its group companies, directors, officers and employees shall not be liable for any indirect, incidental, special or consequential loss arising from unauthorised access to or use of your data by events beyond our reasonable control. Nothing in this policy limits any liability or right that cannot be excluded or limited under the DPDP Act or other applicable law.
